RE: The tariff classification of Trigger Pump Lever from China

Dear Mr. Anderson:

In your letter dated June 3, 2011 you requested a tariff classification ruling on behalf of Kao Brands, Company, Cincinnati, Ohio.

The item under consideration has been identified as a “Trigger pump lever” (part #155470200). It is made of molded plastic which is used on a hand pump spray bottle for hair products. You state in your request that the hand operated lever is used to activate the piston pump to disperse the liquid.

The applicable subheading for the “Trigger pump lever” will be 8424.90.1000, Harmonized Tariff Schedule of the United States (HTSUS), which provides for “Mechanical appliances… dispersing or spraying liquids… parts thereof: … Parts: Of simple piston pump sprays and powder bellows.” The rate of duty will be 2.9 percent ad valorem.

Duty rates are provided for your convenience and are subject to change. The text of the most recent HTSUS and the accompanying duty rates are provided on World Wide Web at http://www.usitc.gov/tata/hts/.

This ruling is being issued under the provisions of Part 177 of the Customs Regulations (19 C.F.R. 177).

A copy of the ruling or the control number indicated above should be provided with the entry documents filed at the time this merchandise is imported. If you have any questions regarding the ruling, contact National Import Specialist Matthew Sullivan at (646) 733-3013.
